1. Acceptance of terms
By accessing or using the Poolytix software, website, and related applications (the “Service”), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
2. Description of service
Poolytix provides a software-based deterministic chemistry engine, data logging tool, and analytical dashboard for pool maintenance. The Service is provided “as is” and “as available.”
3. Assumption of risk and chemical liability
Poolytix is an informational software tool only. Pool maintenance involves handling hazardous, highly reactive, and potentially lethal chemicals (including, but not limited to, muriatic acid, liquid chlorine, and calcium hypochlorite).
- You acknowledge that Poolytix provides mathematical dosing recommendations based solely on the data you input.
- You are strictly and solely responsible for verifying water chemistry readings with a proper, physical drop-test kit before adding any chemicals to your pool.
- You must always read and follow the manufacturer’s safety instructions, warnings, and handling procedures on all chemical labels. Never mix different chemicals together.
- Absolute Limitation of Liability: Under no circumstances shall Poolytix, its founders, employees, or affiliates be held liable for physical injury, death, chemical burns, respiratory damage, equipment degradation, bleached surfaces, environmental damage, or any direct, indirect, incidental, or consequential damages resulting from the use of our dosing engine. You assume total and absolute responsibility for the physical execution of your pool maintenance.
4. User accounts and security
You are responsible for safeguarding the password and authentication methods you use to access the Service. You agree not to disclose your password to any third party and accept full responsibility for any activities or actions under your account.
5. Intellectual property
The Service and its original content (excluding user-provided data), features, logic engine algorithms, and UI/UX design are and will remain the exclusive property of Poolytix and its licensors. The brand name “Poolytix”, logos, and associated trademarks may not be used in connection with any product or service without the prior written consent of Poolytix.
6. Subscriptions, billing, and cancellation
Access to premium features requires a valid subscription purchased through Apple’s App Store on iOS or Stripe Managed Payments on the web.
- Poolytix offers monthly and annual subscriptions. Eligible early members may be offered Founder Annual pricing under the published catalog rules.
- Poolytix does not sell new Lifetime access. Legitimate historical Lifetime access remains recognized as a read-only legacy entitlement.
- Apple handles App Store transactions, receipts, renewals, subscription changes, and refunds under Apple’s terms. Manage an App Store subscription through the app-scoped Apple subscription sheet or Apple’s subscription settings.
- Stripe/Link is merchant of record for eligible web transactions and handles the transaction, tax, receipt, subscription and payment-method management, and transaction support. Use Link for requested web order or subscription changes. Poolytix handles product support at support@poolytix.com.
- A checkout redirect or receipt page does not change access. Poolytix updates an entitlement only after a verified Apple or Stripe event confirms the billing state.
- Deleting a Poolytix account does not cancel or refund an App Store subscription. You must manage or cancel that subscription with Apple before deleting your account.
7. Acceptable use policy
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code or proprietary algorithms of the Poolytix logic engine.
- Attempt to breach, probe, or test the vulnerability of our security architecture.
- Use the Service for any illegal, unauthorized, or commercially abusive purpose.
8. Indemnification
You agree to defend, indemnify, and hold harmless Poolytix and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
9. Governing law and dispute resolution
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration.
10. Modifications to service and terms
We reserve the right to modify or discontinue the Service (or any part thereof) with or without notice. We also reserve the right to update these Terms at any time. Continued use of the Service after any such changes shall constitute your consent to such changes.
